Fan Affiliate Agreement
1. Who this covers
This Agreement is between you ("Affiliate") and FanzPro, LLC. It governs your participation in the FanzPro fan affiliate program, in which you promote artists and their offers using tracked links and earn a commission on qualifying sales.
2. FTC disclosure — you must say you're an affiliate
Federal law (16 CFR Part 255) requires you to clearly disclose your material connection to the artist and to FanzPro whenever you share an affiliate link. Acceptable disclosures include #ad, #affiliate, or a plain-language statement such as "I earn a small commission if you buy through this link."
You must not: (a) claim to be a neutral reviewer while promoting for pay, (b) post fake reviews or testimonials, (c) make earnings, health, or income claims, or (d) use another person's identity to promote offers.
3. Commission
Your commission is displayed inside the FanzPro dashboard next to each offer. Commissions accrue when a buyer completes a qualifying purchase using your tracked link and become available for payout after a 30-day maturation window to cover refunds and chargebacks.
Commissions are reversed if the underlying sale is refunded, charged back, or fraudulent, or if the buyer's address is undeliverable and the order is cancelled.
3a. Two payout flows — and what FanzPro guarantees
Hosted sales (merch, tickets, or downloads sold through FanzPro-hosted checkout): FanzPro is the merchant of record. Your commission is set aside in a ring-fenced fan payout reserve at the time of sale and is guaranteed by FanzPro for payout after the 30-day maturation window, regardless of the artist's account status.
Referral sales (sales the artist processes on their own external store — Shopify, Bandcamp, artist's own site — while FanzPro provides affiliate tracking): the commission is owed to you by the artist. FanzPro collects the commission from the artist's authorized payment method at the time each attributed sale is recorded, holds it in escrow, and forwards it to you after maturation. FanzPro does not guarantee referral-mode payouts. If FanzPro is unable to collect from the artist after our dunning process, the commission may be voided; you will be notified in that event.
Every commission row in your dashboard shows a Hosted or Referral chip so you always know which flow applies.
4. Tax onboarding (W-9 / W-8)
Before your first payout, US Affiliates must submit a valid IRS Form W-9. Non-US Affiliates must submit the applicable IRS Form W-8 (BEN or BEN-E). Payouts are held until tax documentation is on file.
If you do not provide a valid W-9 when required, FanzPro will apply 24% backup withholding and remit it to the IRS. Non-US Affiliates without a valid W-8 are subject to 30% withholding unless a treaty rate applies.
FanzPro issues Form 1099-NEC in January to US Affiliates paid $600 or more in the prior calendar year, and Form 1042-S to non-US Affiliates. You are responsible for reporting affiliate income on your own tax return.
5. Prohibited conduct
You may not: bid on FanzPro or artist brand terms in paid search; spam email, SMS, or forums with your links; use cookie-stuffing, iframes, or auto-clickers; buy through your own link; solicit purchases from minors; or promote in a way that violates the terms of the platform where you're posting (TikTok, Instagram, YouTube, X, etc.).
6. Termination and clawback
FanzPro may suspend or terminate your affiliate account at any time for violations of this Agreement, chargeback rate above 1%, or suspected fraud. Unpaid commissions tied to violating activity are forfeit.
